Memorandum of Understanding (MOU)BetweenҹӰԺ New Mexico Community Collegeand theҹӰԺ New Mexico Community College Employees Union

WHEREAS, the ҹӰԺ New Mexico Community College and the ҹӰԺ New Mexico Employees Union shall be collectively identified as the “Parties” in this MOU.

WHEREAS, the ҹӰԺ New Mexico Community College (“College) and the ҹӰԺ New Mexico Employees Union (Union”) have completed negotiations on a successor Collective Bargaining Agreement (“CBA”) to their current CBA, and

WHEREAS, the Parties are prepared to continue discussions related to employee compensation,

NOW, THEREFORE, the Parties agree as follows:

  1. The Parties shall utilize the provisions of the Labor Management Committee to discuss during the term of this agreement, compensation issues related to the College’s compensation brackets, including recommendations from the ҹӰԺEU. The ҹӰԺEU Vice-President shall represent the ҹӰԺEU at these meetings, and the Vice-President may be accompanied by an additional ҹӰԺEU representative. Upon request of either party and at a mutually agreed upon time, the College representative(s) responsible for administering the bracket study and implementation shall attend the bracket compensation sessions.

  2. In addition, ҹӰԺ-HR will conduct a reclassification review of all Instructional Technician (IT) positions in the School of Skilled Trades & Arts (STA) and the School of Liberal Arts (LA). The review will commence no later than November 1, 2021, and will be completed by January 7, 2022. The parties acknowledge that all reclassifications have three possible outcomes, which are as follows: a) the position increases in grade; b) the position stays the same, or; c) the position decreases in grade. The outcome of the reclassification review is not grievable. The parties also acknowledge that the reclassification review for the IT positions in STA and LA will be conducted in lieu of the provisions contained in paragraph 1 of this MOU.
  3. The above commitments shall not be interpreted by the either Party as a guarantee or a commitment by the College to provide a compensation increase during the 2020-2021 academic year.

  4. This MOU shall commence upon ratification of this MOU and the tentative successor CBA by the ҹӰԺEU membership and the College. The MOU shall expire on August 31, 2022.
